Terms and Conditions
Overview
The Old Port Spirits and Cigars Loyalty Program (the “Program”) is a loyalty reward program offered by Old Port Spirits and Cigars (“OPS”). The Program allows those who have enrolled as a member certain rewards and benefits subject to these terms and conditions.
OPS in its sole discretion can restrict, suspend, amend, extend or otherwise alter the Program Terms at any time and without prior notice. By providing your contact information and participating in the Program, you accept and agree to be bound by these Terms and Conditions.
Enrollment
Membership is free and only available to individuals aged 21 or older. There is no initial purchase required to become a Member. You become a Member by providing complete and accurate information, including at a minimum, full name and email address. Doing so is an indication by you of your acceptance to the Program Terms and Conditions.
You are responsible for any and all activity that occurs in your Account. If you suspect any unauthorized use of your Account, you must notify us immediately. You agree to provide us complete Account information at all times and will inform us of any changes to your information. Only one Loyalty Program is permitted per person.
If OPS determines that a Member has abused any of the Program’s privileges, fails to comply with any of the Program Terms or makes any misrepresentations to OPS, then OPS may take any action it deems appropriate, including without limitation, suspending the Member’s privileges in the Program, revoking any points in the Member’s Account and/or revoking the Member’s membership in the Program, with or without advance notice to the Member. Any decision by OPS in revoking points, or terminating or suspending a Member’s participation in the Program shall be final and binding in all respects.
Account Closure
A Member’s Account will be deemed to be inactive if points are not earned after a period of 1 year. Once an account is deemed to be inactive, all points are deemed forfeited by such Member, with or without notice by OPS. Points are reduced to zero upon closure of a Membership.
Reward Points
Points are earned by Members in connection with purchases of goods either online through the Drizly app, in person or through any other method of payment, provided that the Membership number or Member identifying information is provided at the time of purchase.
Points are given for each dollar spent on a 1 to 1 ratio (excluding tax). The accumulation of 100 points by spending $100.00 entitles Member to a $5.00 gift card. Redemption of the gift card value can occur in person only. Points have no cash value and are not exchangeable for cash. Points can not be assigned, exchanged, traded, bartered, purchased, given or otherwise sold. Any points so acquired are void. You may contact OPS at any time to request a point balance.
Return/Exchange Policy
In the event of a return or exchange of any purchase that initially earned points, such points will be deducted automatically from the Account that was used for the purchase. Points will be deducted at the same rate as earned.
Promotion
From time to time, OPS may advertise or grant exclusive offers to select Members to earn or redeem points or receive other credits or benefits.
Privacy
OPS is committed to protecting your privacy. We will maintain the privacy and security of all personal information collected from Members. Through your use of the Program, you consent to the collection and use of any private information you provide to us. As part of the Program, we will provide you with certain communications, such as service announcements, administrative messages, special offers and promotions. You can unsubscribe from receiving special offers and promotions at any time by contacting us and indicating that you would like to unsubscribe.
Release
Except for willful misconduct or gross negligence on the part of OPS, Member releases OPS and its respective officers, directors, employees, and agents from any an all liability for any loss, harm, damage, cost or expense, without limitation, arising out of or in any way connected with the Program.
Governing Law
The laws of the State of Maine shall govern these Loyalty Program Terms and Conditions. Member consents to exclusive jurisdiction and venue in courts located in Maine for all matters arising in connection with these Loyalty Program Terms and Conditions or Member’s participation in the Program.
